Warning Shots

What would you do in the middle of the night if you heard one or more people trying to break through your locked gate or door? Grab your gun and get ready to confront the intruders? Do you give them a warning shot or do you wait for them to illegally enter your property then take action?

Many of us would answer with an initial warning shot in hopes that we would not have to kill another human being. What if giving the criminals a warning shot landed you in jail?

Recently a resident in Mesquite, Texas faced the same situation mentioned above. He responded with a warning shot into the ground. The would- be culprits ran off and he went to jail. After running the would be thieves off he soon greeted Mesquite police officers and told them of the events and even showed them where he fired into the ground. The officers found the spent casing in the exact area he told them that he fired the warning shot.  The homeowner was arrested and charged with discharging a firearm in a metropolitan area.

Who was in the wrong in this situation? The homeowner? The police? Maybe neither? Should the law about firing your weapon in a metropolitan area have a clause excluding people firing a warning shot to stop criminal activity?

Unfortunately now days it seems that law abiding gun owners have more laws against them than they do for them.  One thing that we do have on our side is that we have the right to face these types of charges in front of a jury of our peers.  For your own protection check out the finer points of the laws concerning discharging your firearm at home to better educate yourself on what you could possibly face in the event that you face the same situation that landed this gentleman in a heap of trouble.
